There will be legislative amendments proposed by NLI At its session on 3 March 2010, Committee for State Supervision of Polish Parliament accepted the Prime Minister’s reply to a desideratum on implementation by the government of the National Labour Inspectorate’s proposals concerning indispensable amendments of legislation. MPs asked for information about which of the NLI’s motions of the type lex ferenda of the last three years are already implemented by the government and which will be taken into account in legislative initiatives in the future.
The reply, prepared by the Minister of Labour in cooperation with Ministers of Economy, Justice, Health and Infrastructure, was presented by Undersecretary of State at the Ministry of Labour and Social Policy Radosław Mleczko. He informed the participants that the labour inspectorate’s suggestions which refer to amendments of legislation, would be analysed by topic teams of the Tripartite Committee for Social and Economic Issues, especially the Team for Labour Law and Collective Agreements. Once the agreement has been reached, further procedures to deal with the proposed amendments will be decided upon. The chairman of Committee for State Supervision Arkadiusz Czartoryski emphasised that MPs were waiting for legislative initiatives of the government. During the same session, the Committee analysed and accepted the Chief Labour Inspector’s reply to the opinion concerning presentation of proposed amendments of legislation in order to increase effectiveness in performing inspections by the National Labour Inspectorate. In the said opinion, MPs asked the Chief Inspector to present suggested legislative amendments which would enable the labour inspectorate to effectively supervise and inspect observance of labour law.
During the debate, Deputy Chief Labour Inspector dr Marian Liwo pointed out that NLI’s suggestions focus on specific legislation, e.g. amendments of provisions on working time, including in health care units, amendments of OSH provisions, but they also refer to procedures for conducting inspection visits. – The point is to amend legislation in such a way as to improve effectiveness of inspections, in the area of, among others, legality of employment and performance of other types of paid work by introducing the possibility of imposing fines in the form of a ticket for offences defined in the act on the promotion of employment and labour market institutions. Another thing which would increase NLI’s efficiency would be the right to conduct specific reconnaissance activities prior to inspections of legality of employment. A decisive aspect here is the scope in which the act on the freedom of economic activity is and would be applicable to inspections conducted by labour inspectors.
